Mr. Gershony’s practice is devoted to complex commercial litigation and arbitration.

He regularly handles disputes concerning real estate and construction; municipal law; breach of contract; disagreements between corporate shareholders and partners; financial fraud and misappropriation; breach of trust and fiduciary duty; employment issues; and tax appeals against the Canada Revenue Agency.  In addition, Mr. Gershony regularly represents clients in the legal marihuana industry concerning commercial disputes and disputes against municipalities.  He has also defended numerous clients facing white-collar and regulatory charges in the wake of the 2008 financial crisis.

Mr. Gershony has diverse experience as an advocate before courts in Canada and the United States, at both the trial and appellate levels.  He practices before all superior levels of court in British Columbia, and has appeared before the New York Supreme Court and the United States District Courts for the Southern and Eastern Districts of New York.  He has also appeared as counsel on briefs before US Circuit Courts, as well as the US Supreme Court.

Mr. Gershony has considerable experience in domestic and international arbitrations and in arbitration-related litigation.  He has represented clients in arbitrations (both administered and ad-hoc) pursuant to various arbitration rules, including the rules of the International Chamber of Commerce and the BC International Commercial Arbitration Centre.

In 2011, Mr. Gershony was a core member of the arbitration team that won the then-largest arbitration award in history (USD 2.5 billion) in The Dow Chemical Company v. Petrochemical Industries Co. of Kuwait (ICC).

Mr. Gershony has devoted hundreds of hours toward pro bono causes.  In 2012, he represented a Florida death-row inmate in a bid to overturn a sentence of death by lethal injection, including before the United States Supreme Court.

Mr. Gershony grew up in Vernon, BC.  He completed his undergraduate studies at the University of Victoria and earned his law degree at the University of British Columbia.  After graduating from law school, he moved to New York and practiced in the commercial litigation and international arbitration groups at Shearman & Sterling LLP.  He then moved back to Canada with his young family and practiced in the Vancouver office of McCarthy Tétrault LLP, one of Canada’s leading national law firms.  In 2013, he moved his family back to the Okanagan and joined Rush Ihas Hardwick LLP, the pre-eminent civil litigation firm in the BC Interior.
